Terms of Sales

Read the following provisions carefully. They constitute the contract specifying the conditions of sale of MUSIC SHOP products and services. The fact of placing an order on this website implies for the customer full and unreserved adherence to these general conditions of sale. The present general conditions of sale govern the relations between MUSIC SHOP and the customer. The customer acknowledges having, prior to placing the order, read all the information constituting the terms and conditions of sale.

Article 1: Preamble

Quotations are valid for one week, unless otherwise stipulated. Despite our best efforts, a small number of the hundreds of items on our site may contain a price error. Rest assured, however, that we proceed with the price verification during the procedure of sending your article. If the corrected price is lower than the price displayed on the site, we will apply the lowest price and send you your article. If the corrected price is higher than the price displayed on the site, we will inform you and proceed to the cancellation of your order unless you choose to accept the order at the new price.

Article 2 : Products

Our offers are valid while stocks last. For products not stored in our warehouses, our offers are valid subject to availability at our suppliers. Errors or modifications may exceptionally occur. In the event of unavailability of non-stocked products after placing your order, we will notify you by email or telephone as soon as we receive information from our suppliers. Unless you want a replacement solution with equivalent hardware, your unavailable order will be automatically canceled and you will be refunded if your bank account has been debited. All the elements such as photographs, graphics, data sheets come from the documents elaborated by the manufacturers, diffused under their control and with their agreement. The products sold in the site comply with the laws and standards applicable in France. For purchases of exported products, you must check the specificity of the legislation in force in the country concerned (tax, declaration, prohibitions, ...) Our responsibility can not be engaged in case of non-compliance with the legislation of the country or the product is delivered, It is your responsibility to check with the local authorities the import possibilities.

Article 3 : Order

Check the conformity of the information you provide when ordering, including the delivery address. We can not be held responsible for any data entry errors and consequences (delay or error of delivery). In this context, the costs incurred for the return of the order will be your responsibility. MUSIC SHOP reserves the right to random control of the information provided by the customer. We may be led to ask you to send us proof of address and / or identity for the validation of your order. Article 4 : Payment

You have: credit card,paypal, check or bank transfer. In case of payment by check, it must be issued by a bank domiciled in France and requires a processing time of 15 days from receipt; a copy of your National Identity Card (C.N.I) being mandatory. This period can be shortened by sending us a photocopy of your C.N.I and proof of address of less than 3 months. Your product will be shipped to you if it is available upon receipt of these parts. An order paid by transfer will be processed upon receipt of your payment, it is cashed immediately. The availability and shipping deadlines start from the date of registration of the payment method. Orders paid by credit cards will be debited immediately. Validating the order form commits you to guarantee that you have the necessary authorizations to use the method of payment you have chosen. We certify that credit card details are encrypted using the SSL protocol, and never transit unencrypted over the network. Payment is made directly to CREDIT MUTUEL via their Cybermut online payment system. Payment is due in full as of the order. The sums collected can not be considered as a deposit. An order is settled when all the products have been shipped and you have paid in full the payment of the products and your participation in the shipping costs. In case of non-payment, unpaid or litigation, we will not make delivery and will not be able to honor your order. We retain the full ownership of the products on sale until the perfect receipt of all amounts due on the occasion of your order. As soon as the goods are shipped, the risk charge is transferred to you. You must therefore ensure the proper conservation of these goods.


Article 5 : Shipping

The products will be delivered to the address you indicated on the order form, for the countries outside of the European Union the taxes and duties charges shall be borne by the customer.
we reserve the final choice of the carrier to send you your parcels. Delivery times are variable depending on the availability of products in our inventory and our suppliers. The deadlines indicated on the site are only indicative. These are generally observed delays. The availability of products may vary from hour to hour. The site is updated daily. However variations can happen. This indication is intended to inform you about the availability at D-1 of our stock. For delivery delays exceeding 15 days after shipment: we will open an inquiry with the carrier concerned to obtain the location of the package. If the merchandise is found, it will be rerouted as soon as possible to your home. Domestic deliveries within France are priced at EUR 3.90 per order. For orders in excess of EUR 25.00, we will post goods within France free of shipping costs.

Article 6 : Receipt of the order


Check the apparent condition of the products on delivery. In the presence of an apparent anomaly we invite you to report it within 48 hours by registered letter with acknowledgment of receipt to the carrier and to Musique shop. At the slightest problem at reception, it is essential that you keep the items in which they were delivered to you (accessories, notices, packaging and packaging included). Article 7 : Return

Article 8 : The retraction

Thank you for reporting your return to our customer service beforehand by email via the contact form or by going to your customer account, in the order concerned, then create an RMA. A return by email will explain the procedure to follow.

You have a withdrawal period of 14 working days to report and return, at your expense, products that do not suit you. These periods run from the day after receipt of the product. Under no circumstances can products subject to personal hygiene be taken back. You can request either the reimbursement of the amounts collected, or an exchange of an amount equivalent to the amounts paid. Return costs are your responsibility. According to the rules applicable to intellectual property, copiable products, such as software, are subject to personal and specific rights of use regulating copying, public distribution and reproduction. You must therefore comply with the general conditions of sale of audio or video recording supplies or software which prescribe not to unseal the packaging before exercising the right of return, as authorized by article L. 121-20 -2 of the consumer code.

Product returns are made under the following conditions:
The withdrawal period only applies to individuals.
The product must not have been removed from its original packaging, and the packaging must be in new condition. If the product has been used, the reimbursement will be reduced by a wear allowance of at least 30%, the product then being considered second-hand, and not resale in new condition to another customer.
Furthermore, orders whose products are "on special order" cannot be canceled or refunded.
In general, any product return must be at the expense of the customer, who takes full responsibility for the proper delivery of the goods to the premises of MUSIQUE SHOP. It is your responsibility to declare the value of the product, as it results from the purchase invoice and to ensure that the return risk insurance is perfectly covered, in connection with the purchase invoice. Packages travel under your responsibility.
Note that a prior return agreement is essential, any package returned without an agreement is systematically refused and the return shipping costs are invoiced to you.
No returns can be made directly in our store.

Your liability is only incurred with respect to a possible depreciation of the merchandise resulting from manipulations other than those necessary for Musique Shop to ensure the nature and proper functioning of the merchandise.
 
In the event of refusal of delivery, the return shipping costs are the responsibility of the customer and deducted from the reimbursement of the order (flat rate: €45)
Under no circumstances may the withdrawal period apply if the billing is established in the name of a company.

Article 9 : Warranty

We invite you to immediately contact our S.A.V. The products purchased on our site benefit from the manufacturer's warranty. Manufacturer's warranties are generally two years, parts and labor. In case of breakdown during the warranty period, repairs will be provided free of charge by the national network of centers, stations or technical agencies approved by the manufacturers. You must keep the purchase invoice to benefit from the guarantees. The return is exercised according to the terms of Article 7.
 
Article 10 : Warranty 30 days

In addition to the 14-day statutory withdrawal period, Musique Shop also offers the consumer a satisfied warranty spanning the next 16 days. The customer can send us back within 30 days the goods received, without being required to mention any reason. The period begins to run upon receipt of the goods.
The return costs are the responsibility of the customer.
The customer can request the refund within the first 14 days. From the 15th day we proceed to a product exchange at equivalent price or you can ask a voucher for the value of it. In no case we may be required to refund the sums received past the statutory withdrawal period.
This warranty does not apply to custom products (flycase, ...), software, products subject to personal hygiene (reed, mouthpiece, ...), consumables (ropes, cables, ...) and sound card .

Article 11 : Taxes and exports

Orders are invoiced all taxes included (TTC) when the amount is under 135 GBP. If it's more than 135 GBP the order will be without the VAT (HT) and the taxes and duties charges shall be borne by the customer. You will be entitled to the reimbursement of the French VAT corresponding to the product (s) ordered (s) if you meet the conditions required to receive tax rebate. We refuse any request for tax refund which does not correspond to the conditions specified by the customs services. Any request related to the tax refund and / or the T.V.A. intra-community will have to be formulated after invoicing of (the) product (s) referring to it.
